ANNEX 1 TO THE CUSTOMER TERMS OF SERVICE OF THE JOLO APP AND TO THE DRIVER TERMS OF SERVICE OF THE JOLO APP - LIST OF PROHIBITED SHIPMENTS

effective as of 21 August 2026

§ 1.

General provisions

1.       This List of Prohibited Shipments (hereinafter: the “List”) sets out the items excluded from carriage performed through the App.

2.       Capitalized terms used in the List have the meaning given to them in the Driver Terms of Service of the JOLO App and in the Customer Terms of Service of the JOLO App (hereinafter: the “Terms of Service”).

3.       The List is binding on both Drivers and Customers, to the extent that the Terms of Service refer to it.

4.       The Customer is obliged to provide in the App a description of the Shipment that reflects the actual state of affairs and not to order the carriage of items indicated in § 2 of the List.

5.       The Driver is obliged to refuse to accept or perform a Transport Order covering items indicated in § 2 of the List and to report that fact to the Service Provider.

6.       The Service Provider does not verify the contents of Shipments and is not liable for items covered by the List being ordered for carriage or accepted for carriage.

§ 2.

Items excluded from carriage

1.       The following are excluded from carriage through the App:

1)       dangerous goods within the meaning of the Agreement concerning the International Carriage of Dangerous Goods by Road (ADR), in particular explosive substances and articles, gases, flammable liquid and solid substances, substances liable to spontaneous combustion, oxidizing substances, organic peroxides, toxic and infectious substances, radioactive material and corrosive substances;

2)       weapons, ammunition, explosives and pyrotechnic articles and their essential parts, within the meaning of the Act of 21 May 1999 on Weapons and Ammunition and of the Act of 13 June 2019 on the Conduct of Business Activity in the Field of the Manufacture of and Trade in Explosives, Weapons, Ammunition and Products and Technology for Military or Police Use;

3)       narcotic drugs, psychotropic substances, new psychoactive substances and precursors, within the meaning of the Act of 29 July 2005 on Counteracting Drug Addiction;

4)       human corpses and remains, as well as human cells, tissues and organs;

5)       live animals;

6)       cash, banknotes and coins, payment cards, securities, cheques, bills of exchange, precious metals and stones, jewelry and other monetary valuables;

7)       works of art, antiques, collectors’ items and objects of artistic, scientific or historical value;

8)       identity documents, official documents and other documents and data carriers that cannot be reproduced or whose reproduction is significantly impeded;

9)       items derived from a criminal offence or items the possession of or trade in which is prohibited by law;

10)    goods infringing the intellectual property rights of third parties, in particular counterfeit trademarks;

11)    materials and media containing content whose dissemination is prohibited, in particular content depicting the sexual abuse of minors and content inciting hatred or violence;

12)    waste within the meaning of the Act of 14 December 2012 on Waste, including hazardous waste and medical waste;

13)    animal carcasses and animal by-products;

14)    items requiring carriage at a controlled temperature, including perishable foodstuffs, medicinal products and vaccines – unless the Driver has a Vehicle adapted to such carriage;

15)    items whose dimensions, weight, properties or manner of packaging prevent them from being safely carried by the Vehicle concerned, or which exceed that Vehicle’s permissible load capacity or cargo-space volume as indicated in the Price List;

16)    items with a value exceeding PLN 5,000.00;

17)    items that are unpackaged or packaged in a manner that does not correspond to their properties, where their properties require packaging that protects them against damage in transport.

§ 3.

Carriage restrictions

1.       A Shipment covering a single item weighing more than 80 (eighty) kg may be the subject only of a Scheduled Order.

2.       The Customer is obliged to indicate in the description of the Shipment that it covers an item referred to in para. 1.

3.       The Driver may refuse to perform a Transport Order covering an item referred to in para. 1 if the Vehicle or the available equipment does not allow it to be safely loaded and carried.

§ 4.

Consequences of a breach

1.       Where it is established that a Shipment covers items excluded from carriage, the Driver refuses to accept or perform the Transport Order and reports that fact to the Service Provider without delay.

2.       If the circumstance referred to in para. 1 comes to light after the carriage has commenced, the Driver is entitled to interrupt it and, where necessary, to hand the Shipment over to the competent authorities.

3.       The Customer is liable for any damage resulting from ordering the carriage of items covered by the List, including for damage to the Vehicle, to other shipments and damage suffered by third parties, as well as for the costs related to the interruption of the carriage.

4.       Ordering items covered by the List for carriage, or accepting them for carriage, constitutes a breach of the Terms of Service and may result in the measures provided for in § 4 of the Terms of Service being applied to the User, including the blocking of access to the App.

§ 5.

Amendments to the List

1.       The List is amended under the procedure provided for amendments to the Terms of Service to which the List constitutes an annex.

2.       Transport Orders concluded before the date on which an amendment enters into force are governed by the List in its previous wording.
